Judge strikes down DOMA

A California judge struck down a “key provision” of the Defense of Marriage Act tonight in a case involving a federal employee seeking benefits for her same-sex partner - the first ruling like this since the Obama administration announced it would no longer defend DOMA.

From ABC:

Karen Golinski, a lesbian woman married to her spouse under California law, brought the suit after she was unable to secure federal health benefits for her same-sex spouse.

U.S. District Court Judge Jeffrey S. White said, “In this matter, the court finds that DOMA, as applied to Ms. Golinski, violates her right to equal protection of the law under the Fifth Amendment to the United States Constitution by, without substantial justification or rational basis, refusing to recognize her lawful marriage to prevent provision of health insurance coverage to her spouse.”

Woohoo! Every single news blurb like this represents a small but significant victory. We’re getting there.

Washington state has legalized same-sex marriage. Washington’s legislature passed a bill legalizing same-sex marriage Wednesday by a 55-43 vote, making Washington the 7th state to do so.

Gov. Chris Gregoire says she will sign the legislation into law next week.

Washington joins Connecticut, Iowa, Massachusetts, New Hampshire, New York, and Vermont (and Washington D.C.) in granting marriage licences to same-sex couples.

State Rep. Jamie Pedersen (D-Seattle), who is gay, spoke on behalf of the approved bill:

“I would like for our four children to grow up understanding that their daddy and their poppa have made that kind of a lifelong commitment to each other. Marriage is the word that we use in our society to convey that idea.”

BREAKING: 9th Circuit Court Rules Prop 8 UNCONSTITUTIONAL | NOH8 Campaign:

Nearly one and a half years since Federal District Court Judge Vaughn Walker declared Proposition 8 to be unconstitutional in the landmark Perry v. Brown case, the 9th US District Circuit Court of Appeals finally announced this morning that they will beupholding Judge Walker’s decision: PROPOSITION H8 IS UNCONSTITUTIONAL!

Opponents of same-sex marriage will likely file an appeal to the decision, and the next steps may inevitably lead to a hearing before the US Supreme Court; casting the national spotlight on California’s fight for the freedom to marry and putting the focus on same-sex marriage at a federal level. Most importantly, today’s rulings open up the door for the same arguments to be used to the benefit of advancing pro-same-sex marriage legislation in other states.

What does this mean in the now? When can same-sex couples in California begin to get married again? The imposed stay on permitting same-sex marriages will likely stand in anticipation of further appeals; but we will update this page as more information becomes available.

For now, we must celebrate this huge advance for gay rights and continue this year’s momentum of the positive forces for change we’ve seen in places like Washington state, Delaware, Hawaii, and of courseNew York. This is an incredible day for couples not only in California but across the United States, and we will continue to share the details of what this decision means as we learn more.

In addition to ruling on the constitutionality of Proposition 8, there were two more issues for the 9th Circuit to rule on. First, they were to decide whether or not Prop 8 Supporters have the standing under federal law to appeal Judge Walker’s decision: they have ruled they do, mirroring the California Supreme Court’s decision this past November. Second, the 9th Circuit had to decide if Judge Ware (who took over for the now retired Judge Walker) was correct in denying a motion from Prop 8 supporters that would overturn Judge Walker’s decision based on the the revelation that Judge Walker failed to disclose he was in a committed same-sex relationship himself. The 9th Circuit has ruled that Judge Ware was indeed in the right and dismissed the motion to vacate, reaffirming that Judge Walker’s relationship has no bearing on the merit of his decision.

In the meantime, one of the most important notions to gain from today’s victory is that there is promise, there is hope, and that with enough perseverance and patience, we can achieve the equal rights we deserve. We need to focus on figuring out what each of us can do from here to help the movement in our own way. Everybody has their own way of speaking out, and we have to celebrate those differences and encourage people to bring their own personal talents to the table. We want full recognition of equal rights for everybody on a federal level, and all of us are going to have to work together to do it!

So many people and organizations, particularly AFER, have played such a pivotal role in this historic decision. The NOH8Campaign was born out of the passage of Prop 8, and we’re proud to be a part of the fight. Even still, we couldn’t do what we do without such incredible dedication and help from each of you in the community. If not for your support, NOH8 would have never made it past California — and here we are, three years later, having been to three countries and well over half of the United States spreading our message of hope and acceptance. Prop 8 was just the beginning; we will continue to fight and advocate for those without a voice until everybody is equal.

More than 75 mayors from around the country have joined forces to declare their support for marriage equality.

“Mayors for the Freedom to Marry” is hoping to garner nationwide support for marriage equality starting at a local level, including support from the mayors of the country’s four largest cities and mayors from states where marriage equality will soon be on the ballot. The full list of mayors is here.

This is absolutely fantastic news. Local leaders are speaking out for what’s right, and I’m sure this list is only going to keep growing. Way to go.

LGBTQ Identities Part I - Sexual Identities

Heterosexual: Sexual attraction towards those of a different binary gender.

Homosexual: Sexual attraction towards those of the same gender.

Bisexual: Sexual attraction towards two genders or gender the same or different to yours.

There’s a lot of debating about my provided definition of bisexual. As of now, the definition of bisexuality is very, very subjective. Within the bisexual community (myself included) there are many who are attracted to non-binary individuals and still identify as bisexual.

The term pansexual has not always been around, and many bisexuals identified as bisexual even though the “proper” definition did not fit them as they liked.

Those of us who are attracted to non-binary people have since been fighting for the definition of bisexuality to include us, or at least include the provided definition as another or alternative.

This “wrong” definition of bisexuality was in fact created by bisexuals, not people who aren’t or people who “don’t understand bisexuality” or “are confused about terms.”

Pansexual: Sexual attraction towards all genders.

Polysexual: Sexual attraction towards multiple genders.

Skoliosexual: Sexual attraction towards genderqueer or non-binary people.

Androsexuality: Sexual attraction towards men or masculinity.
*Depending on the person they may use Androphilia. I’ve heard both used for

Gynesexuality: Sexual attraction towards women or femininity.
*Depending on the person that may use Gynophilia.

So, I’m sure most of you are familiar with a similar post that included several icons that had an identity and then a simple definition underneath it. Unfortunately that post was severely problematic. It had exclusive and erasing wording and had several definitions wrong with it.

I decided to create my own with more inclusive language, less erasive language, and proper definitions. (Though definitions can vary from region to region.) These icons are not all of the LGBTQ identities out there.There are limitless identities, and these are just some of the sexual identities that I know of.

Before you say “what about the asexuals?” like so many people before you, you might want to take the time to keep reading before you throw a fit.

This is also not the only one of these I’ll be doing. I’ll be creating more sets. One of which will be for asexual/demisexual/grey-a identities and another will be for gender identities. Stay tuned.

I’m very open to corrections and suggestions as long as they’re not rude.
